Tall Audio Terms and Conditions

We hope we’re speaking in plain English and that the below is understandable, but please do drop us a line if you need any clarification.

  1. The Basics

1.1 Definitions Customer: The company, person or firm dealing with Tall Audio Ltd.

1.2 Acknowledgement By placing orders with Tall Audio Ltd, the Customer acknowledges and agrees that: (i) This is a business transaction into which both parties are freely entering. (ii) There are clauses within these Conditions which exclude, limit, or modify the liability of any Tall Audio Ltd representative and provide a right to indemnity from the Customer in certain circumstances.

1.3 Contractual Terms All agreements with the Customer are entered into solely on these Conditions. If there is any issue with the details, the Customer should contact us before work commences. Any variation must be agreed in writing by both parties.

1.4 Exclusion of Customer’s Terms Tall Audio Ltd shall not be bound by any conditions of business of the Customer unless such conditions are:

  • Provided to us directly, and

  • Accepted by Tall Audio Ltd in writing (signed by a director or approved proxy) before work commences.

  1. Quotation

2.1 All quotations are given by Tall Audio Ltd without obligation.
2.2 We quote as accurately as possible and will note any anticipated variable costs (e.g., mileage, food).
2.3 Additional charges may be added to the invoice if unforeseen expenses (e.g., extra kit or consumables) prove necessary to ensure job quality.
2.4 Wherever possible, we will inform production of these costs as they arise.

  1. Bookings & Orders


3.1 Orders may be placed verbally or in writing and become binding at that point. Cancellations must be confirmed in writing.
3.2 If a Purchase Order (PO) is required for payment, it must be provided to confirm the booking.
3.3 Customers are assumed to have full production insurance. If not, the Customer must inform Tall Audio Ltd at the time of booking.
3.4 Tall Audio Ltd reserves the right to refuse any order without assigning a reason.

  1. Professional Standards


4.1 Tall Audio Ltd will always offer a professional, friendly, and courteous service. We expect the same in return. Feedback on our standards is welcome at sally@tallaudio.co.uk.
4.2 We act with honesty and integrity and strive to deliver agreed services. Tall Audio Ltd shall not be liable for any loss or damage arising from advice, instruction, or guidance given.

  1. Cancellation

5.1 Tall Audio Ltd reserves the right to charge for any costs or expenses already incurred if a contract is subsequently cancelled.
5.2 Cancellation fees:

  • Less than 24 hours’ notice: 100% of the agreed quote.

  • 25–48 hours’ notice: 50% of the agreed quote.

  • 49–72 hours’ notice: 25% of the agreed quote.

  1. Hiring Equipment

6.1 General a. The hire period starts when equipment leaves Tall Audio Ltd premises and ends when it is returned or at the agreed period’s end, whichever is later. b. Timing details will be specified verbally or in your quote. c. Extensions must be discussed with a Company Director (Alex or Paul) as soon as possible. d. All hired equipment remains the property of Tall Audio Ltd.

6.2 Loss or Damage a. The hirer is responsible for loss or damage during the hire period; repair or replacement costs are the hirer’s responsibility. b. Hire charges continue until lost/damaged equipment is repaired or replaced. c. Delivery/collection risks and expenses lie with the Customer, who must insure equipment in transit and use.

6.3 Late Returns & Repossession a. Late returns incur the daily hire rate per 24-hour period or part thereof. b. Tall Audio Ltd may repossess equipment from any premises, with Customer cooperation and compensation for costs incurred.

  1. Equipment Usage

7.1 Equipment must only be used for the agreed purpose and within the agreed jurisdiction.
7.2 Customers must ensure qualified, experienced operators and protect equipment from damage.
7.3 No modifications or incompatible accessories may be added without prior consent.
7.4 Tall Audio Ltd is not liable for loss or damage from misuse or inability to use equipment.
7.5 Only authorised drivers may operate hired vehicles; appropriate insurance must be in place.
7.6 While advice is provided, Tall Audio Ltd does not guarantee desired results.
7.7 Equipment may not be sold, loaned, or transferred; insolvency triggers immediate termination and charges.

  1. Condition of Goods

8.1 All equipment is tested before hire. Customers should perform their own inspections. Defective items will be replaced or remedied at no extra charge.

  1. Customer’s Insurance

9.1 Dry Hire: Customers must insure equipment, noting Tall Audio Ltd’s interest and providing policy details.
9.2 Production: For combined crew and equipment bookings, adequate production insurance is required.
9.3 Customers must indemnify Tall Audio Ltd against any third-party claims related to equipment use or supplied services.

  1. Payment

10.1 Provide any required PO before job commencement; failure may lead to cancellation.
10.2 Invoices are payable in full within 14 days to our bank account.
10.3 Late payments may accrue interest per the Late Payment of Commercial Debts (Interest) Act 1998.
10.4 After 30 days’ non-payment, a reminder email will be sent; absence of response may lead to statutory demand proceedings.
10.5 Defaulting customers may face equipment withholding or contract cancellation without notice.
10.6 Tall Audio Ltd may terminate contracts immediately upon customer bankruptcy or insolvency.

  1. Legal Provisions

11.1 These Conditions do not exclude liability for death or personal injury from negligence (Unfair Contract Terms Act 1977, s.1).
11.2 No exclusions of liability under the Sale of Goods Act 1893 (s.12) or Supply of Goods Implied Terms Act 1973 (s.8).
11.3 Not liable for delays due to causes beyond our control (e.g., strikes, lockdowns). 11.4 Governed by English law.
11.5 Tall Audio Ltd excludes liability for indirect or consequential losses, late delivery, defects, or staff errors.
11.6 Time is not of the essence; no liability for supply delays.
11.7 All equipment/materials are at the Customer’s risk. Limited tape replacement liability applies only to magnetic tape damaged due to Tall Audio Ltd’s fault.
11.8 Advice or recommendations are provided without liability for resulting loss or damage.
